Welcome to GentleParkPlace ("we," "us," or "our"). The following Terms & Conditions ("Terms") manage your utilization of our yacht charter services and our website at gentleparkplace.rest (the "Service") operated by GentleParkPlace.
When you reserve a yacht charter or use our Service, you are compliant with these Terms. Should you not agree with any part of these terms, access to the Service is not permitted to you.
2. Service Overview
GentleParkPlace offers high-end yacht charter services, which include but are not restricted to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is subject to change and dependent on weather conditions. We reserve the authority to alter or halt our offerings at any given time without prior notice.
3. Booking and Reservations
3.1 Booking Process
In order to book a charter, you are required to:
- Have at least 18 years of life
- Submit precise and current information
- Provide payment for the necessary deposit detailed in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A reservation is only secured once payment has been made and you receive our written confirmation. We retain the right of refusing service at our own discretion.
3.3 Availability
Our charter booking is contingent upon the vessel's availability and appropriate weather conditions. We shall strive to honor your preferred scheduling.
4. Payment Terms
4.1 Pricing
All fees are quoted in € and are inclusive of applicable taxes, unless stated otherwise. Our prices may change intermittingly without notification.
4.2 Payment Schedule
- Deposit: 50% of the total charter fee is due upon booking
- Balance: The remaining amount is payable 48 hours before the departure of the charter
- Any supplementary charges: These are payable upon the completion of the charter
4.3 Payment Methods
We accept most major credit cards, bank transfers, and certified cheques. Our payment processing utilizes secure, encrypted systems for transactions.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than a 72-hour notice before departure: Full refund excluding processing charges
- Within 24 to 72 hours before departure: A refund of 50%
- Less than 24 hours before departure: No refund will be issued
5.2 Weather Cancellations
If our captain deems the weather unsafe, we will propound to:
- Move your charter to the next possible date free of any extra cost
- Issue a complete refund if rescheduling proves to be infeasible
5.3 Mechanical Issues
If the vessel assigned experiences mechanical conflicts, we will make an effort to supply a comparable alternative. Should an alternate not be obtainable, a full refund will be imparted.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Comply with all directives provided by the crew
- Don safety gear when mandated
- Inform us of any medical conditions impacting their safety
- Stay within assigned areas on the vessel
6.2 Prohibited Items
The following items are not permitted on board:
- Glass containers
- Illegal substances
- Firearms or other weapons
- Excessive drinks (beyond reasonable consumption)
- Pets, unless they have been pre-approved
6.3 Conduct
Guests are expected to behave respectfully. If passenger conduct poses a danger to safety or disrupts the charter for other patrons, we maintain the right to terminate the experience prematurely without reimbursement.
7. Liability and Insurance
7.1 Our Liability
We limit our accountability to the sum you have paid for your charter. We are not liable for:
- Injuries to persons due to their own disregard
- Missing or damaged personal belongings
- Indirect, incidental, or punitive losses
- Delays provoked by inclement weather or circumstances beyond our management
7.2 Insurance Coverage
We carry comprehensive marine insurance for our vessels and operations. It is incumbent upon our passengers to arrange their own travel and personal insurance.
7.3 Assumption of Risk
By electing to partake in our charter services, you recognize that maritime activities possess inherent risks and you accept full responsibility for your own safety and welfare.
8. Modifications and Itinerary Changes
We reserve the option to adjust itineraries, courses, or schedules due to weather conditions, safety protocols, or operational imperatives. We will endeavor to offer alternate experiences of comparable quality.
9. Force Majeure
We shall not be held liable for disruptions, cancellations, or alterations instigated by events outside our control, which may include, but are not limited to:
- Extreme weather scenarios
- Natural catastrophes
- Governmental edicts
- Terminal shutdowns
- Vehicular malfunctions
10. Privacy and Data Protection
Your private data is handled in line with our Privacy Policy. By engaging our services, you consent to the gathering and usage of your data as outlined in our Privacy Policy.
11. Intellectual Property
Our website's content, encompassing text, imagery, logos, and graphics, is safeguarded by copyright and trademark legislation. The reproduction, distribution, or creation of derivative works is prohibitive without our explicit written consent.
